Red Hat Shows Up in the SCO Bankruptcy - Tells SCO, Not So Fast!(Groklaw)
“Not so fast” is right.
The public has all but forgotten that Red Hat does have a legal action pending against SCO for the false and harmful statements that SCO has made against Red Hat. Of course, that action has been stayed pending the outcome of the SCO bankruptcy.
I have to laugh when SCO lawyers now claim that all SCO was doing was saying the same thing that everyone else was saying about Red Hat. What a lie. Everyone else was not saying that Red Hat was violating SCO copyrights. Copyrights that SCO has been determined to not even hold.
It may be true that SCO's false claims had significantly less affect than SCO might have hoped. After all if you are going to lie about someone in public you might hope that somebody would believe you and harm would actually result. And now SCO is acting like it was only promoting Red Hat products in a similar fashion to how IBM and others have done so. Pure poppy cock.
But, then what else can SCO say?
They are being sued by Red Hat. The Utah court has decided that SCO does not hold the copyrights they have claimed. And, SCO is bankrupt. You might as well claim no harm no foul. Besides SCO still has their appeal pending, right? I mean against all odds SCO may actually get a chance to argue its case before a jury. Never mind that SCO has never demonstrated that it has any relevant evidence to show a jury. Hint: That is why the summary judgment was ordered.
SCO lawyers knew from day one they never had a case. And they defrauded SCO out of those legal fees just the same. And, today, they get to put their name on pleadings like you see here. It is clearly an example of some of the worse legal work imaginable.
SCO should never have brought any of these legal proceedings. But, we honestly do not know if SCO management was this stupid or they were deceived by the SCO lawyers out to earn a big fat fee. It all depends upon what SCO lawyers told SCO management about these legal issues. “This is a pile of crap. But, the nuisance value is unmeasurable. Besides Microsoft is paying, right?”. Well, SCO is going down for the count. And SCO lawyers are primarily responsible for not acting in the best interest of their client. SCO management has also failed to act in the best interest of the SCO shareholders. What else can you say?
Frankly I doubt that SCO will try to resolve the Red Hat claim before the bankruptcy judge. They do not want to address it at all in any courtroom.
